TERMS OF SERVICE

We take pride in our craftsmanship and aim to make this process as simple as possible. By paying the initial deposit, authorizing the start of work, or paying any portion of an invoice, you (the “Client”) agree to the following terms:

CLIENT AGREEMENT

  • Our Guarantee: All labor and installation services are guaranteed to be free from defects for one (1) year from the date of completion. If a defect in our workmanship is discovered, our sole obligation is to return and correct the issue at no labor cost to you.
  • What's Not Covered: This guarantee covers labor only. Materials, fixtures, and appliances are covered by their respective manufacturer warranties. We cannot warranty against normal wear and tear, owner neglect, or natural settling of the home. Any alteration of our work by a third party voids this guarantee.
  • Payment: {{PAYMENT_TERMS_SENTENCE}}
  • Limited Liability: To the extent permitted by Florida law, the total liability of The Palm Beach Fixer LLC for any claims related to a project shall not exceed the total amount actually paid by the Client under the specific invoice.
  • Severability: If any provision of these terms is held invalid or unenforceable under Florida law, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

STATUTORY DISCLOSURES

Construction Defect Notice (Chapter 558, Florida Statutes): ANY CLAIMS FOR CONSTRUCTION DEFECTS ARE SUBJECT TO THE NOTICE AND CURE PROVISIONS OF CHAPTER 558, FLORIDA STATUTES.

Licensing: This service provider is not a licensed contractor. All work performed constitutes minor maintenance and repair as defined by Florida Statute 489.103(9). No work requiring a professional contractor license or building permit has been performed.

FLORIDA LIEN LAW NOTICE

ACCORDING TO FLORIDA'S CONSTRUCTION LIEN LAW (SECTIONS 713.001-713.37, FLORIDA STATUTES), THOSE WHO WORK ON YOUR PROPERTY OR PROVIDE MATERIALS AND SERVICES AND ARE NOT PAID IN FULL HAVE A RIGHT TO ENFORCE THEIR CLAIM FOR PAYMENT AGAINST YOUR PROPERTY. THIS CLAIM IS KNOWN AS A CONSTRUCTION LIEN. IF YOUR CONTRACTOR OR A SUBCONTRACTOR FAILS TO PAY SUBCONTRACTORS, SUB-SUBCONTRACTORS, OR MATERIAL SUPPLIERS, THOSE PEOPLE WHO ARE OWED MONEY MAY LOOK TO YOUR PROPERTY FOR PAYMENT, EVEN IF YOU HAVE ALREADY PAID YOUR CONTRACTOR IN FULL. IF YOU FAIL TO PAY YOUR CONTRACTOR, YOUR CONTRACTOR MAY ALSO HAVE A LIEN ON YOUR PROPERTY. THIS MEANS IF A LIEN IS FILED YOUR PROPERTY COULD BE SOLD AGAINST YOUR WILL TO PAY FOR LABOR, MATERIALS, OR OTHER SERVICES THAT YOUR CONTRACTOR OR A SUBCONTRACTOR MAY HAVE FAILED TO PAY. TO PROTECT YOURSELF, YOU SHOULD STIPULATE IN THIS CONTRACT THAT BEFORE ANY PAYMENT IS MADE, YOUR CONTRACTOR IS REQUIRED TO PROVIDE YOU WITH A WRITTEN RELEASE OF LIEN FROM ANY PERSON OR COMPANY THAT HAS PROVIDED TO YOU A “NOTICE TO OWNER.” FLORIDA'S CONSTRUCTION LIEN LAW IS COMPLEX, AND IT IS RECOMMENDED THAT YOU CONSULT AN ATTORNEY.
